"Seizure caused shooting." 22 year old Yousel Rivera of Cape Coral has been charged with shooting a Cape Coral police officer. Jury selection started last week, but has been put on hold because one of the attorneys involved has a medical problem.
According to psychiatrist Dr. Alan Waldman, the light from the deputy's flashlight caused Rivera to have a seizure. Dr. Walden continued stating that Rivera had suffered from seizures from the time he was a child. Dr. Walden added that people suffering from these types of temporal lobe epileptic seizures can experience impulses and cannot control their actions.
This sounds like a good defense as long as there is medical evidence to back it up. However, being under the influence of Marijuana at the time of the alleged offense could cause problems. Let the system do its job and allow the jury to see all the evidence.
