Mistrial declared in sex offense case

GRAHAM – A judge declared a mistrial Friday after jurors said they couldn’t reach verdicts on the charges against a Snow Camp man accused of sex offenses with a child.

Jurors told Superior Court Judge Paul Gessner they were deadlocked in their deliberations on two counts of first-degree sex offenses with a child and two counts of indecent liberties with a child against Brian Travis Flinchum.

Flinchum, 28, of 2235 Fire Tower Road, Snow Camp, was charged in 2010 after an 11-year-old boy said Flinchum touched him inappropriately and coerced him into performing sex acts. Flinchum’s trial began Tuesday, and jurors began deliberating Wednesday afternoon.

At 3:15 p.m. Friday, the jury notified Gessner that they were deadlocked. The forewoman wiped away tears as she told the judge she didn’t believe additional deliberation would result in a verdict in any of the charges.

Jurors were split 10-2 on two charges, 6-6 on another, and 9-3 on a final charge, the forewoman said. Gessner told her not to say which charges those counts corresponded to.

“The fact that you didn’t reach a unanimous verdict doesn’t mean you’ve failed in any way. This is what our system is based on,” Gessner told jurors. “You’ve obviously taken this matter very seriously.”
