Hernando deputy charged with DUI won’t be prosecuted

A Hernando County sheriff’s deputy arrested on DUI charges last month will not be prosecuted.

According to the Tampa Bay Times, the State Attorney’s Office cited a lack of evidence and conflicting witness accounts in deciding not to go forward with the case against Deputy Joseph Tibor.

A Florida Highway Patrol trooper pulled over a white Mercedes sedan Tibor was driving on State Road 50 west of Brooksville on Jan. 12. The Mercedes was going 85 mph in a 55 mph zone, trooper Cpl. David Fye wrote.

According to Frye’s report, Tibor, 45, flashed his badge and had trouble finding his license in his wallet. He had glassy, bloodshot eyes, and his breath smelled of alcohol.

Tibor then failed sobriety tests, according to the report, and was arrested. He refused to give a breath sample at the Hernando County Detention Center.
