ESTERO -The woman accused of hitting and dragging a motorcyclist down US-41back in May is scheduled to appear in court Friday afternoon for a plea hearing.
Investigators say Donna Brown was drunk and high when she hit and killed Carl Edward Patrick.
She is charged with DUI Manslaughter, DUI Property Damage, Hit and Run with Death, DUI and Careless Driving.
Her license was revoked after the crash, but investigators say she was caught driving. Subsequently, she remains behind bars at the Lee County Jail.
In November, a Lee County judge granted a defense motion to exclude blood results from the trial, meaning her blood alcohol content will not be brought up.
Test results show her blood alcohol content was more than twice the legal limit at the time of the crash. However, the Florida Highway Patrol did not get a required warrant before administering the test.
The state says it still has enough evidence to go forward with the trial.
