Convicted of DUI Manslaughter
DUI Manslaughter: A 46 year old Broward County man has been sentenced to 15 years (which is the maximum sentence for DUI Manslaughter) in prison for the death of a Miami Heat dancer. The 22 year old dancer was driving her motorcycle and stopped at the median when Mario Careaga ran her over with his Mercedes.
Careaga claims that he was attempting to get away from a dangerous driver when his Mercedes swerved and ran into and threw Nancy Lopez-Ruiz 137 feet. It is alleged that he crossed three lanes of traffic.
Careaga admitted that he had been drinking at the mall, but said he had not drinking enough to be considered impaired even though his BAC was three times the legal limit of .08. An hour before the crash, he is seen on video at a function with a glass of champagne in his hand an hour. Authorities say that Careaga swayed back and forth, had glassy bloodshot eyes, slurred his words and smelled of alcohol.
Careaga will appeal the judge’s decision his attorneys have begun the appellate process. Careaga was taken into custody, immediately after the judge’s ruling, but will be released on bond in the near future. Since Careaga does not have a criminal record coupled with his strong ties to the community he will be able to stay out on bond during the appellate procedures.
